What You Should Do After a Car Accident?
Stay on the scene. Never leave the accident scene.
To the extent that you can, stay calm. You may be in shock, adrenaline coursing through your veins. Take deep breaths and try to stay grounded.
Check yourself, your passengers, and your vehicle for damage. Should someone be injured, do not move them unless it’s to remove them from the potential for further harm. Make sure they’re warm.
If you’re able to do so without putting yourself and others at risk, remove yourself from harm’s way. Get out of the road, away from the flow of traffic, away from the edge, etc. Again, if you are able, warn oncoming traffic with your hazard lights and/or any flares.
After you’ve gotten to safety, call 911. Tell the police what happened. Even if you don’t think you need medical assistance, get it. Some of the worst injuries don’t appear at first, but they manifest over time. So many times, someone thought they escaped an accident unscathed only to find that they suffered internal injuries and worse later on. Get examined by medical professionals as soon as you can.
If you can do so safely, document evidence. Take pictures and videos. Focus on damage: to yourself, passengers, vehicles, the environment, and so forth.
Get the information of other parties involved only once it’s been established that everyone is OK and help is on the way. The names of all the drivers, their license plates, insurance companies, and policy numbers – document it all. Don’t admit fault or say anything that can be construed as admitting fault. Your discussion should be direct and simple. If there are any witnesses, get their information, too.
Once you’ve done all of the above, reach out to an experienced car accident attorney.
When’s the Right Time to Hire a Car Accident Attorney?
As soon as possible. There’s no benefit to waiting. In California, the statute of limitations is two years from the date of the accident. However, depending on certain factors, it could be less than that. The sooner you reach out to us, the sooner we can get to work on your behalf.
That’s just for the state, however. In California, if the accident resulted in more than one grand in property damage or if anyone in the accident was hurt or killed, then you have ten days to notify the DMV. That’s not the same as suing for damages, but it’s one more action that very well may be necessary quickly.
Another reason to contact an attorney quickly: the other side will not hesitate. They will start immediately, doing everything in their power to ensure that you receive little to no compensation for your injuries. They could offer you a lowball offer right after your accident, hammer you with questions in hopes of getting you to say something that could harm your case, and other unsavory (but sometimes effective) tactics.
We can keep them from doing that. When you sign with us, we make it clear that the insurance company should deal with us, keeping them from further pestering you. We strongly recommend you reach out for a free case evaluation soon after your accident.
What Benefits You May Be Entitled to In a Car Accident
If you were hurt in a car accident, you may be entitled to many benefits. Specifically, you may be eligible for both economic as well as non-economic damages. Economic damages can pay for the costs that may have resulted directly from your accident. Any doctor’s trips, evaluations, medical bills, surgeries, therapy, rehab, transportation, modifications to your home, and more – economic damages can cover that.
This also covers damages to your vehicle, such as any repairs it may need, reimbursement for out-of-pocket expenses you may have accrued due to the accident, and more.
We can also help you to recover damages for wages you lost because you were unable to work as a result of the accident, or unable to work your job to the capacity that you did before the accident. Indeed, we may even be able to help you recover the wages you’ll lose in the future from being unable to work your job then as well, too.
Non-economic damages cover that which you’ve had to go through which does not have a price tag attached. These damages compensate you for your pain, your suffering, loss of enjoyment of life, loss of consortium, and more.
When you reach out to us for a free case evaluation, we’ll go over your case thoroughly. From there, we’ll draw upon our experience to let you know definitively which damages you may be entitled to. From there, we’ll work tirelessly to make sure that you receive all of them.
What are Common Car Accident Injuries?
No two car accidents are the same. Each is different, and each challenges the victim in a different way. That said, over the years, we have helped our clients to successfully receive maximum compensation for many different kinds of injuries. They include:
- Broken bones.
- Road rash, cuts due to the road, and so forth.
- Head injuries
- Traumatic Brain Injuries
- Neck Injuries
- Severe bruises
- Emotional problems (such as anxiety, PTSD, and other emotional concerns that may arise as a result of the accident).
No matter what your injuries are, if you suffered them as a result of someone else’s negligence and/or recklessness, we’ll help you to receive everything you deserve.
What Causes a Car Accident?
Car accidents in and around Los Angeles can come from so many different factors. Among the most frequent causes:
Breaking the Speed Limit. Speed limits are there for a reason. Excessive speeding can make it impossible for drivers and pedestrians to remove themselves from a vehicle’s path.
Distracted Driving. Phone calls, texting, watching videos, checking directions, social media, and so many other distractions can keep a driver from making the right decision.
DUI. Across the country, statistics have shown that basically, 33% of all traffic accidents involving a fatality are due to the driver being on drugs or intoxicated.
Vehicle Defects. A more common cause of vehicular accidents than many think, an accident could be caused by engine malfunctions, seat belt defects, brake issues, and more.
Poor Driving. Changing lanes too suddenly, being too close to the driver in front of them, speeding through a stop sign, and other mistakes can cause injuries and cost lives.
Who May Be Liable for My Car Accident?
The truth is that there could be many parties who are liable for your vehicular accident. Yes, more often than not, the liable party is the other driver(s), those whose negligence and/or recklessness caused the accident which injured you.
That said, it’s entirely possible that they aren’t the only liable party. If you were hit by a truck driver, for example, then the person who employed them could be liable for your accident. It could also be that whoever loaded cargo into their truck was liable, those who were to maintain the other vehicle properly but did not, those in charge of the roads, and so forth.
It’s our responsibility to find all of the parties responsible for your injuries. We’ll bring a case against all who are liable, even if they were just partially liable. That way, you can receive maximum compensation for everything that you’ve been through.
